Nelson Mandela released from hospital in South Africa

JOHANNESBURG, South Africa -- Former South African President Nelson Mandela was released from a hospital in Pretoria on Wednesday evening, a government spokesman told NBC News.

Mandela, 94, had been admitted more than two weeks ago for what were described as routine tests but then was treated for a recurring lung infection and then underwent surgery to remove gallstones.

Mac Maharaj, a spokesman for President Jacob Zuma, told NBC News that doctors were satisfied with?Mandela's progess and that the anti-apartheid hero will receive "high care" at his Johannesburg home.

Zuma had visited Mandela on Christmas Day and had said he was "in good spirits."


"He was happy to have visitors on this special day and is looking much better. The doctors are happy with the progress that he is making," said Zuma.

Mandela, who came to power in historic elections in 1994 after decades struggling against apartheid, remains a symbol of resistance to racism and injustice at home and around the world.?

He has a history of lung problems dating back to when he contracted tuberculosis while in jail as a political prisoner. But this is his longest stay in hospital since he was released from prison in 1990.

He spent time in a Johannesburg hospital in 2011 with a respiratory condition, and again in February this year because of abdominal pains though he was released the following day after a keyhole examination showed there was nothing serious.

Zuma, who has just been re-elected as president of the ruling African National Congress party, last week described Mandela's condition as serious.

"The Mandela family truly appreciates all the support they are receiving from the public. That is what keeps them going at this difficult time," said Zuma.?

Mandela spent 27 years in prison, including 18 years on the windswept Robben Island off Cape Town.?

After his release, he used his popularity to push for reconciliation between whites and blacks. This reconciliation is the bedrock of the post-apartheid "Rainbow Nation."

Sworn in as South Africa's first black president in 1994, Mandela stepped down in 1999 after one term in office and has largely been absent from public life for the last decade.

His fragile health has prevented him from making any public appearances in South Africa, though he has continued to receive high-profile domestic and international visitors, including former U.S. President Bill Clinton in July.

Mandela now will receive treatment at his home in Houghton, a suburb of Johannesburg.?

AIPLA Exclusive: On the Record with Todd Dickinson, Part 2 ...

On September 6, 2012, I spent the day at the offices of the?American Intellectual Property Law Association(AIPLA) to get a behind the scenes view of what goes on at the largest of industry organizations for intellectual property law. ?My initial article on my day was published at?Exclusive: Behind the Scenes at the AIPLA.

At the conclusion of my day at the AIPLA I sat down for an on the record conversation with Q. Todd Dickinson, the current Executive Director of the AIPLA and former USPTO Director. ?In Part 1 of the interview we discussed how it is possible for the AIPLA to stay on top of the numerous, never-ending issues that present themselves in the Courts and at the USPTO.

In this final installment of my interview with Dickinson we discuss the Federal Circuit, including the rumors that I have heard about him possibly being on a short list for a future appointment to the Federal Circuit. As you will see, Dickinson deflected those rumors, although acknowledging they are flattering. ?We then move on to talk about judicial appointments in general, as well as the next big issue that will face the Federal Circuit in the coming years.

Without further ado, here is the conclusion of my interview with Todd Dickinson.

QUINN: Now, I don?t know whether you had an opportunity to see when I interviewed Bob Stoll recently.? One of the things I asked him was, what names he is hearing for potential appointment to the Federal Circuit.? And he said, you.? Two years ago I interviewed Don Dunner and he gave me his short list and again you were on that short list.? And I would say you would be on my short list, too, and I?m happy to tell you why.? And I?m not necessarily going to ask you do you want the job, are you lobbying for the job.? But when you hear people like Bob Stoll and Don Dunner say that they think you would make a good Judge, how does that make you feel?

DICKINSON: Well, that?s very flattering, but I really can?t comment on that.

However, we have,? prepared a white paper which we presented to two White Houses in a row now, talking about the kind of characteristics we?d like to see in appointees.? We haven?t singled names out, at all, but we?ve indicated what kind of characteristics we think would benefit the Court and make for good appointees.? For example, we thought that it would be a very good idea, and we support it as others have, the idea of having a district court judge with trial experience.? So we were very pleased, of course, that Judge O?Malley was appointed.? We also would like, and this may even be more relevant now that Judge Linn is? taking senior status, somebody who comes from a more of a pure patent background, who has it kind of baked in, if you will, and knows the systems and the new statute.

QUINN: ?Yes.? And that?s one of the things that I worry about.? Not that I don?t like the appointment of any of the Judges. I mean, I think they?re all great, I think they?ll all be fine, and they are all highly qualified. Of course, I disagree with them a lot, but I disagree with a lot of people and enjoy the debate.? But I do worry that over the next handful of years we may find ourselves with few or no patent people on the Federal Circuit.

DICKINSON: Hopefully that worry won?t be realized, but we?ll see. ?As I said,? I think we in our white paper would like to see? consideration given someone with a solid patent background for at least one of the next few? appointments.

QUINN: Okay.? I?ll leave it at that.? I prodded you enough there, I appreciate you playing along.? Now, on a more broad level, what issues do you see coming up in the IP community in the long term?? Because if I had told people ten years ago that here in 2012 we would be dealing with the biggest issues being related to patent subject matter, I think most people would have looked at me like I was crazy.

DICKINSON: I think that?s a pretty big? surprise.? But I think one of the biggest issues, and where we should be focusing, is on international harmonization, which fortunately is where Director Kappos seems to be focusing a lot of his attention.? I think the time is ripe, and I think we as an organization are very pleased that he?s put that back on the table so aggressively.? I think in many ways it?s a legacy issue for this generation of leaders.? When I first came into the office in the 90s we had negotiated I think five or six treaties. Some of them pure IP, some with major IP implications, such as TRIPS .? But there?s been a gap after that, and the next big thing has always been getting to substantive harmonization.? There are structural reasons, political reasons why that hasn?t worked as well as it might have.? But I think we have an opening, a significant opening now with the AIA passage and first-inventor- to-file that should really provide the new opportunity? For President Battistelli, Director Kappos, Commissioner Iwai and his successors from the Japanese Office and others, this is an opportunity to really leave something behind. So we?ll see what happens on that issue.

Domestically, I agree with you.? I?m a little surprised by the real strong focus that?s been placed on 101 issues, patent eligibility issues. It is, in many ways, cyclical , however.? Twenty years ago when I first was getting involved with policy issues, the big question was whether living organisms were patentable as a policy matter.? Should bacteria, even if they were genetically modified by people, be patentable subject matter.? That question is really gone from the table.? The generation before that, should atomic energy, should nuclear weapons be patentable subject matter, that sort of thing.? And we go through these waves of discussion about it, what?s interesting? is that several of the debates are connected strongly to the most important technologies that we?re working on at the moment.? Biotech genetics, software and IT, and the? Supreme Court?s great challenge if they want to stay in that area, is to make sure that they are mindful of the bigger picture implications of what those kind of decisions might lead to.

QUINN: Well, I?ll throw this out at you.? The thing that worries me most about this is it seems to me that the people pushing patentable subject matter issues we could characterize as the anti-patent community. And that is troublesome to me because I know what a patent means to the business community, particularly the small business and start up business.and the reality is that in the sound byte world that we live in, they win.? Because the patent story is not one you can tell in ten seconds.

DICKINSON: Well, it?s I think one of those debates we could have forever; whether patents incent or dis-incent technological development.? I think that there?s obviously a lot of evidence that we wouldn?t have the system that we have at this point, without having? it as an incentive and is helpful to protect particularly?protect and nurture new technologies.? That said, there are an awful lot of very compelling arguments that are made on both sides.? And if that?s the way you frame up the argument, you?ve created a tough call.? I don?t think the argument necessarily needs to be framed that way, to be honest.

QUINN: Let me peel another layer of the onion to get to where I?m thinking. I think a lot of these cases could simply be decided by recognizing a poorly drafted claim.? And these poorly drafted claims do not actually represent the innovation in a fair way.? But that?s not what we wind up getting from the Supreme Court, they make it this big global issue when we as patent attorneys can say, you know, in retrospect you could have written it this way or maybe you should have written it that way, or? maybe this was a test claim to see how far you could go.

DICKINSON: There?s a? legal clich? that?s been? around forever, that? tough cases can make bad law.? And a corollary to that would be, I think, bad facts can make bad law too. I can?t tell you how many times people have said, well, this claim is poorly written and? I can?t believe that?s the one the Supreme Court took.??? And to go from a situation where, for example, the examiner has 120 cases before them in a year, on average, where they?ve got to make the kind of determinations the Supreme Court makes once every 30 years on obviousness or? even 101, is intriguing.? You?re worried that the world view that the courts get is sufficient in terms of the overall process.? But we?ll see.? That?s the way the system is set up for them to do it.? If they take more and more cases, they may get an ever more rounded view of the challenges of hitting this thing right.

QUINN: Maybe they will.? Because there for a while the popular belief was that if the Supreme Court is taking the case it?s going to be to overturn. and there have been a few others where maybe they said, ah, it wasn?t necessarily the only test but you came out with the right to ultimate outcome.

DICKINSON: I think also 101 is an? area where the broad outlines of the issue are? fairly easy to grasp.? If the question comes down to, is it patentable subject matter in a new technology especially, within the? confines of how? we have defined it before I think, can be a? tempting target for a Supreme Court to take a look at.? However,? it is the boundaries of 103 or 112 which comprise the bulk of cases in the pipeline that will more importantly shape the jurisprudence, but those may not seem as interesting, or as sexy as a caseload, I don?t know.

QUINN: Yes, and that?s the other thing I worry about, too, because 103 is the big ticket issue.? And we?ve got some situations where prior art gets interpreted sometimes in bizarre ways at the Patent Office.? And not that I think?

DICKINSON: For example, I think a potentially? next big question? is likely going to be along the lines of Cyborg, the standard under which the CAFC reviews district court cases. I think as an important and pragmatic and practical question that may likely be reviewed which? would have significant implications.

But don?t forget, the most contentious issues by far, are ?those dealing with the very real concerns that the software and IT community has about the impact of non-practicing entities, and a lot of the debate during the pendency of the AIA is? about what was the right approach to deal with the problem.? What happened, interestingly, was the Courts listened and were? not unmindful? of what was happening in the world.? They understand that a number of these issues were created by court decisions, by the common law, and they had the opportunity to take a fresh look at them, to make things a little clearer, a little more nuanced, a little more aware of their implications.?? And interestingly, they? did that almost across the board.? They did it in damages, they did injunctions, the Supreme Court in eBay, they did it with willfulness, they did it in equitable conduct and Therasense, you know, you can go right down the list.

QUINN: And yet we still have the problem.

DICKINSON: The issue?s out there. I would submit the big issue in the public policy arena has moved beyond the story of the troll.? It?s not quite so much trolls any more, though that still exists, as it is the cell phone wars.? Now maybe you say one leads to the other, but we?re talking big money now, we?re talking big boys now.

QUINN: Right.? Which I guess to some extent that has kind of gone away.? I think probably more so because of the AIA and some of the venue things.? And to make it more difficult to sue 150 unrelated people.

DICKINSON: I think that?s true.? I think again we?re very proud of the fact that the AIPLA filed a brief in the Volkswagen case in the 5th Circuit, which led directly to TS Tech, the case on venue.? Which gave the Eastern District more discretion in terms of where those cases would be brought .? I think you can draw a direct line there, and an appropriate one.? And you start to see they are taking an open-eyed view of? what the impact of the tough venue, the purer venue had led to.

QUINN: I think that one of the problems with the whole troll thing that I saw, and I have kind of a different definition of ?troll? than most because I think the patent is a right, you?re granting a right if you own the right and somebody is infringing that right, they are a tortfeasor, it?s not that the patent owner is bad for wanting to get paid for the right that?s getting trampled. But there are a whole bunch of these people out there, small players, largely any more, that will get a patent and then go after every Mom and Pop that they think has got enough money to collect something but not enough money to hire an attorney.? And that?s where the problem is, is with the pre filing investigation.? And they don?t care.

DICKINSON: And they?ll settle for the cost of litigation. I think you?ve got a problem.? When that happens repeatedly, you?ve got a system that has a major problem there.

'Price Is Right' reveals its first male model

Rob Wilson will be the first male model of "Price Is Right."

Move over, ladies of "The Price Is Right"! You've got a guy competing with you for eyeballs!

CBS on Friday revealed the winner of its first-ever model search, Rob Wilson of Boston. He beat out hundreds of other hopefuls who showed up for an open call in late August, and worked his way into the top three. Wilson landed the one-week gig after facing off against fellow finalists Clint Brink and Nick Denbeigh by writing and singing original lyrics to the show's theme song, showing his excitement when he was asked to "Come on down!" and more. The decision was made by fan votes, who cast their ballots during the period of Sept. 28 to Oct. 4.

Wilson begins his one-week job as the show's first male model on Monday, Oct. 15. "The Price Is Right" airs weekdays at 10 PT /11 ET a.m. on CBS.

Campaign launched for asteroid-hunting telescope

Leaders of the B612 Foundation explain their plan to launch the first privately funded deep-space mission, aimed at mapping the inner solar system.

Leaders of the nonprofit B612 Foundation today took the wraps off a campaign to fund and launch a space telescope to hunt for potential killer asteroids?? a campaign they portrayed as a cosmic civic improvement project.

Former NASA astronaut Ed Lu, the foundation's chairman and CEO, estimated that hundreds of millions of dollars would have to be raised to fund the project, but said he was "confident we can do this."

"We've been at this particular project for a year now," Lu told me in advance of today's campaign kickoff at the California Academy of Sciences' Morrison Planetarium in San Francisco. "We have people who are internationally well-connected, and we have a message that we think resonates with people ranging from large donors to perhaps half a million kids worldwide."


The foundation's aim is to identify and map the orbits of half a million asteroids that are on trajectories approaching Earth over the course of five and a half years, using a spacecraft that's launched into a Venus-type orbit on a SpaceX Falcon 9 rocket in the 2017-2018 time frame.

Apollo astronaut Rusty Schweickart, B612's chairman emeritus, said the task could be key to humanity's long-term survival.?"We feel a certain urgency to get on with it so that we can be confident that we're not going to have a cosmic disaster here for no good, justifiable reason, just because we didn't get with it," he said in a statement. "So let's get with it. That's the name of the game."

What's the risk?
The potential risk posed by near-Earth asteroids was highlighted earlier this month when a kilometer-wide (0.6-mile-wide) asteroid called 2012 LZ1 sailed within 3.3 million miles (5.3 million kilometers) of our planet, just a few days after its discovery. If a rock that big were to hit Earth, it could end civilization as we know it. Smaller asteroids, around 40 meters (130 feet) in diameter, could set off atom-bomb-scale explosions?like the 1908 Tunguska impact, which flattened 500,000 acres (2,000 square kilometers) of forest in Siberia.

Ground-based telescopes and space probes such as the NASA's now-defunct Wide-field Infrared Survey Explorer have found thousands of near-Earth asteroids, including an estimated 90 percent of the planet-killers measuring a kilometer or more wide. But there are hundreds of thousands more yet to be found in the Tunguska-or-bigger range.

The B612 Foundation, which takes its name from the asteroid that was home to the main character in a children's book titled "The Little Prince," was formed in 2002 to advocate strategies for deflecting potentially hazardous asteroids. A little more than a year ago, the foundation decided to shift its focus to mapping the inner solar system.

"Over the years it became clear that deflecting asteroids is a solvable technical problem as long as there is adequate early warning (decades of notice)," the foundation said in a briefing paper. "It also became clear that the job of tracking asteroids to provide early warning was not going to be accomplished by others in a timely fashion."

What's the mission?
To track more asteroids, the foundation proposes launching the Sentinel Space Telescope, a 1.5-ton, 25-foot-tall (7.7-meter-tall) observatory that draws upon design features from NASA's Spitzer Space Telescope and Kepler planet-hunting probe. Ball Aerospace was involved in both those earlier space projects, and would be the prime contractor for the Sentinel. The craft would carry a 20-inch (50-centimeter) telescope with an infrared imager.

Lu said the telescope's design has been nearly completed under the leadership of mission director Harold Reitsema, an astronomer who recently retired from Ball Aerospace. Negotiations are currently under way with Ball Aerospace on a fixed-price contract to build the Sentinel, Lu said. He declined to be specific on the mission cost because of those negotiations.

The mission plan calls for the craft to be launched on a Falcon 9 into a slightly elliptical orbit between Earth and Venus. From that vantage point, the Sentinel could look out toward the vicinity of Earth's orbit with the sun behind it?? which would be ideal for spotting space rocks like 2012 LZ1. Image data would be beamed down to NASA's Deep Space Network and passed along to the mission's data operations center at the Laboratory for Space Physics in Boulder, Colo. Newly identified asteroids would be reported to the International Astronomical Union's Minor Planet Center, in accordance with existing procedures, and the orbital data would be analyzed by NASA's Jet Propulsion Laboratory to assess potential hazards.

The B612 Foundation said it signed a Space Act Agreement with NASA on June 19 in support of the mission. The foundation has also been in contact with SpaceX's engineers to discuss technical details for the anticipated launch, Lu said.

What are the chances?
The fund-raising challenge could be as daunting as the challenges associated with spacecraft development. But Lu said the success of SpaceX's commercial resupply mission last month boosted his confidence that a non-governmental space effort could be successful. After his 2007 retirement from NASA's astronaut corps, Lu worked for three years as a Google executive, and he was inspired to go forward with the Sentinel project when he returned to Google's Silicon Valley headquarters to give a talk.

"I told them the essential problem was that nobody is mapping the asteroids," he recalled. "One of the guys there said, 'Why don't you just go and do it?' ... And then we said, 'Hey, maybe we can.' It was eye-opening to me to see how commonplace these types of fund-raising projects are."

Lu pointed out that the estimated cost of the mission, amounting to a few hundred million dollars, was comparable to the cost of building a performing arts center, a museum, or a planetarium like the one where today's briefing was being held. The San Francisco Museum of Modern Art, for example, has raised more than $437 million in its current capital campaign. "There are 50 to 100 projects larger than ours going on at any time in the United States, and nobody bats an eye," he said.

He also recalled that many of the world's best-known observatories, including the Palomar Observatory, the Lick Observatory and the Keck Observatory, were built with private financing. "I think of this as following in the precedent of large ground-based telescopes, from a funding standpoint," Lu said.?

It would be nearly unprecedented, however, to mount a space mission exclusively with private donations. The nonprofit Planetary Society and Cosmos Studios tried to do so in 2005 when they financed the launch of the Cosmos 1 solar sail on a Russian submarine missile ??but that $4 million mission failed, and the follow-up LightSail 1 mission has not yet been launched.

NASA looked into launching an asteroid-hunting probe years ago, but never went forward with the mission because it was deemed too expensive. The cost was estimated at $500 million nine years ago, Tim Spahr, director of the Minor Planet Center, told The Associated Press.

Spahr questioned whether enough could be raised for the Sentinel project, given the state of the economy. "This is a hard time," he told AP.

Kite Surfer Jumps Pier During Tropical Storm Debby (VIDEO)

As Tropical Storm Debby threatened Florida's Gulf coast over the weekend, one adventurous kite surfer took to the sea to take advantage of the rad winds and waves.

A video that was featured on Reddit's front page shows the daredevil surfing the waves near the shoreline just before jumping over a pier.

Those filming the action gasp in anticipation as the kite surfer comes around (0:44) and takes "flight" over the pier at Redington Beach before landing safely on the other side, WTVR reports.

"He's obviously a professional," one man exclaims.

According to the video's uploader, Jay Gartner, the athlete had already performed the stunt once before.

Professional or not, surfers and swimmers are usually discouraged from heading into the ocean as storms approach.

Hurricanes and tropical storms often bring strong waves that can create hazardous rip currents, according to National Geographic. Although surfers are usually able to ride the currents on their boards, the formations pose danger to swimmers, who may become exhausted fighting the strong current and put themselves at risk of drowning.

According to a National Weather Service advisory, Debby has weakened into a tropical depression and isn't expected to strengthen much within the next 48 hours. As of 11 a.m. EDT on June 27, the storm was moving away from Florida with maximum sustained winds of about 35 mph.

The storm brought more than two feet of rain to parts of Florida and caused flooding and power outages across the state, the Associated Press reports. At least three deaths have been blamed on the storm, according to CNN.

A look at the ruling upholding Obamacare

WHAT DOES THE RULING MEAN TO ME?

The Supreme Court decision upholding President Barack Obama's health care law affects nearly every American. The law tells almost everyone they must have health coverage and guarantees it will be available to them even if they are already ill or need hugely expensive care. It helps the poor and many middle-class people afford coverage.

WHAT THE JUSTICES SAID

The high court upheld almost all of the law, including the most disputed part: the mandate that virtually all Americans have health insurance or pay a fine. The court said that fine is essentially a tax, and that's why the government has the power to impose it.

The ruling limited the law's plan to expand the Medicaid insurance program for the poor, a joint effort of the federal government and states. It says the U.S. government cannot withhold a state's entire Medicaid allotment if it doesn't participate in the expansion.

Chief Justice John Roberts sided with the court's four liberal justices ? Stephen Breyer, Ruth Bader Ginsburg, Elena Kagan and Sonia Sotomayor ? to form the 5-4 majority.

HUGE POLITICAL IMPACT

The court upheld Obama's signature legislative achievement. Final word from the court amplifies the most polarizing issue of his re-election campaign against Republican Mitt Romney.

GOP lawmakers and Romney have promised to repeal the law if they are in power after the November election.

WHAT NOW?

The 2010 health care law will keep taking effect. It's expected to bring coverage to about 30 million uninsured people. Overall, more than 9 in 10 eligible Americans will be covered.

Some parts are already in effect: Young adults can stay on their parents' insurance up to age 26. Insurers can't deny coverage to children with health problems. Limits on how much policies will pay out to each person over a lifetime are eliminated. Hundreds of older people already are saving money through improved Medicare prescription benefits. And co-payments for preventive care for all ages have been eliminated.

WHAT'S NEXT?

Starting in 2014, almost everyone will be required to be insured or pay a fine. There are subsidies to help people who can't afford coverage. Most employers will face fines if they don't offer coverage for their workers. Newly created insurance markets will make it easier for individuals and small businesses to buy affordable coverage. And Medicaid will be expanded to cover more low-income people.

Insurers will be prohibited from denying coverage to people with medical problems or charging those people more. They won't be able to charge women more, either. During the transition to 2014, a special program for people with pre-existing health problems helps these people get coverage.

An assortment of tax increases, health industry fees and Medicare cuts will help pay for the changes.

STILL, NOT EVERYONE WILL BE COVERED

An estimated 26 million people will remain without coverage once the law is fully implemented, including illegal immigrants, people who don't sign up and choose to face the fines instead, and those who can't afford it even with the subsidies. That number could be higher, depending on whether any states refuse the Medicaid expansion.

THE TAXING TRUTH

When the law was before Congress, Obama and Democrats avoided calling its penalty for going uninsured a "tax." But the administration argued before the Supreme Court that the law was constitutional as a federal tax. The court rejected two other Obama administration arguments for the law but accepted the tax one.

In 2016, after the law is fully in place, about 4 million people will pay the penalty to the Internal Revenue Service for being uninsured, the Congressional Budget Office has estimated. They would pay $695 per uninsured adult or 2.5 percent of family income, up to $12,500 per year.

The IRS can't prosecute violators or place liens against them, however. Its only enforcement option may be withholding money from refunds.

WHAT ARE REPUBLICANS SAYING?

"Obamacare was bad law yesterday. It's bad law today," Romney said after the ruling.

The Republican-led House already has voted for repeal but can't push it forward so long as Obama's in the White House and Democrats lead the Senate ? making the November elections crucial.

Senate Republican Leader Mitch McConnell called the court decision "a fresh start on the road to repeal."

OBAMA'S REACTION

Obama says the decision upholds the fundamental principle that in the wealthiest nation on earth, no one should be ruined financially by an illness or accident.

He called it "a victory for people all over this country whose lives will be more secure because of this law."

ABOUT THAT MANDATE

Many parts of the law have proven popular. But the insurance mandate is widely disliked.

Each time AP has asked in polls, more than 8 in 10 Americans have said the government should not have the right to require everyone to buy health insurance.

The public also has tilted against the law as a whole over the two years since it was passed. About half opposed it and a third were in favor in an AP-GfK poll shortly before the Supreme Court ruled.

Baseball Expert Tony DeMarco has been covering the big leagues since 1987, and been casting Hall of Fame ballots for the last 14 years. He answers questions weekly here:

Q. It seems like we're having no-hitter alerts frequently, and offenses are struggling overall. What are the reasons for this, and is this a fluky thing, or a sign of a larger trend?
? Kurt Roberts, New York

A. There definitely is a larger trend here, and it's simply that we've fully gotten beyond the inflated offensive numbers of the Steroids Era, and returned to relative normalcy.

There has been a perfect game and two no-hitters this season, one in each month of the season: the White Sox's Philip Humber (perfect) in April, the Angels' Jered Weaver in May and a sextet of Mariners earlier this month.

The 2012 MLB average for runs per game is at 8.6 through Monday ? up a tick from last season's 8.56 mark, which was the lowest since 1992.

In contrast, the peak of the Steroids Era was 2000, when the average runs per game was 10.28. That number also exceeded 10 runs per game in 1996 and 1999, was above 9.5 for an eight-year stretch of 1994-2001, and was at least 9.0 every year from 1993 to 2009.

But notice the decline since 2006: (9.72); 2007 (9.6); 2008 (9.3); 2009 (9.2); 2010 (8.76); 2011 (8.56), 2012 (8.6).

The numbers from the last three seasons are in line with those from the early 1970s to the early 1990s. As many know, pitching mounds were lowered from 15 inches in height to 10 after the 1968 season ? the so-called Year of the Pitcher ? when runs per game average dipped to just 6.84 after being in the 7s from 1963-67, when a handful of future starting pitcher Hall of Famers were in their peak years.

Batting averages, home runs and slugging percentages have made similar declines in recent seasons:

MLB teams peaked at a .271 season batting average in 1999 (also .270 in 1994, 1996 and 2000), while the current average is down to .253.

Home runs peaked at 2.34 per game in 2000, and currently are down to 1.98 per game.

The average slugging percentage topped out at .437 in 2000, and currently sits at .402.

And in this season, the number of sub-.200 hitters ? and I'm talking about regulars or at least platoon players ? is alarmingly high. Put it this way: Mario Mendoza has plenty of company, as through Monday, there are no fewer than 14 players hitting under .200 with at least 100 at-bats:

Russell Martin (.197), Carlos Pena (.197), Jose Molina (.195), Gaby Sanchez (.194), Ike Davis (.191), Shelley Duncan (.191), Chone Figgins (.191), Rickie Weeks (.185), Brendan Ryan (.179), John Buck (.175), Nick Hundley (.172), Ryan Raburn (.168), Geovany Soto (.165), Xavier Nady (.157).

As for the reasons why, let's first give credit where it's due. Some elite-quality arms have entered the majors in the past few seasons, and they are making their marks: Stephen Strasburg, Clayton Kershaw, Chris Sale, Brandon Beachy, Yu Darvish, Madison Bumgarner, Wade Miley, Jordan Zimmerman, Matt Harrison, Ivan Nova, Jeremy Hellickson, Aroldis Chapman, Craig Kimbrel, and the list could go on.

The next reason that should be obvious is the drug-testing program ? instituted in 2006 and beefed up since ? is working.

Another perhaps underrated reason is improvements on defense ? both in the speed and range of fielders, and in the more-aggressive positioning of defenders according to charts that show where hitters are most likely to put the ball in play.

It used to be that an infield shift was isolated mostly to left-handed pull/power hitters. Now you see teams ? led by the Tampa Bay Rays ? employing shifts of infielders for several hitters in a lineup.

So even though the trend in new parks has leaned heavily to offense-friendly dimensions, other factors have led to the recent decline in runs.

Q. Josh Hamilton is skipping the Home Run Derby again, saying he doesn't want to get hurt. Boston fans are saying Adrian Gonzalez's swing hasn't been the same since last year's Derby. Are these isolated concerns, or is the Derby a real danger to players?
? Jim Alford, University City, Calif.

A. Sure, there are understandable concerns ? mostly in front offices ? that competing in the Home Run Derby ? and for that matter, All-Star Games and World Baseball Classics ? can lead to injuries.

But as far as the Home Run Derby is concerned, to say there is any longer-term negative affect on regular-season performance from altering a swing to compete in the derby is ridiculous. A couple of weeks maybe, but anything beyond that, and any hitter who's great enough to be invited to participate in the Home Run Derby should be able to make any necessary adjustments.

First of all, unless you go deep into a derby competition, you're not doing much more than a regular daily batting practice session ? although admittedly there will be adrenalin pumping as in a game situation.

Nobody is certain why Gonzalez's numbers are so far off his career norm, but to blame it on last year's derby participation makes no sense. That statute of limitations expired long ago. Other factors obviously are involved, and it usually involves pitchers finding and exploiting weaknesses. Playing out of position wasn't helping him, either.

As for Hamilton, there could be some trepidation on his part given that he's in a contract year. He's also battling a big slump right now that has tempered his awesome start to this season. We also have to consider that he's already put on what might be the greatest derby performance we'll ever see, so he really does have nothing to prove at this point.

MLB obviously would love to have Hamilton (and Matt Kemp) participate, but it's the players' call, and team front offices also are going to err on the side of caution with the long-term financial investments they've made in their superstars.

Q. With talk about bringing in the fences as a few parks, do you know if there is a basic guideline for the distances fences should be from home plate?
? Frank, Seattle

A. The official MLB rule book doesn't get any more specific than this: "A distance of 320 feet or more along the foul lines and 400 feet or more to center field is preferable.''

Obviously, there are exceptions: The 37-foot-high Green Monster in Fenway is listed at 310 feet down the left-field line, although many believe it's closer than that to home plate. The Pesky Pole in the right-field corner in Fenway is 302 feet away.

The center-field wall in Minute Maid Park is 436 feet away ? furthest in the majors, and up a hill, besides. But the left-field wall there is only 315 feet away (but 19-feet high) leading to many home runs lofted into the Crawford Boxes.

And sometimes, distance is only part of the equation. The right-field corner at AT&T Park is 309 feet, but the 25-foot wall and marine conditions make it one of the toughest right-field home run parks in the majors, unless you're Barry Bonds.

But as a whole, ballparks are more-uniform than they used to be. For example, in the Polo Grounds ? arguably the most-extreme park in history ? it was 279 feet down the left-field line, 483 feet in center, and 258 feet down the right-field line.

Screenwriter Nora Ephron Dead At 71

Oscar-nominated writer of 'Sleepless in Seattle' and 'When Harry Met Sally ... ' died of pneumonia.

Academy Award-nominated screenwriter and director Nora Ephron died Tuesday (June 26) from pneumonia. She was 71. News of Ephron's passing first hit the Internet late Tuesday when journalist Liz Smith, a friend of Ephron's, published a column remembering the late director.

"She never gave the answer I expected to anything. She was grave in her humor, which made it deadly, unexpected, truly funny and dauntingly intelligent," wrote Smith. "She seemed never to want or expect anything, while always demanding the best from the rest of us. She was — always — right and somehow left the smartest, most ambitious and silliest of us in the dust at her feet."

Ephron lived a storied life both on set and behind the scenes. Born in New York City in 1941 and raised in Beverly Hills, California, Ephron worked as a journalist for numerous years before trying her hand writing and directing for film. Her writing appeared in such outlets as Esquire and New York, and she was even married to Carl Bernstein of Watergate fame from 1976 until 1980. She later wed screenwriter Nicholas Pileggi in 1987; they remained married until the time of her death.

In 1983, Ephron's first major Hollywood movie, "Silkwood," arrived in theaters. Starring marquee names including Meryl Streep, Kurt Russell and Cher, Ephron's "Silkwood" was based on the true story of Karen Silkwood, who was killed in a suspicious accident during her investigation into the unethical practices of the nuclear power plant that employed her. The film was nominated for five Oscars, including one for Ephron's screenplay.

Over the course of her career, Ephron cemented her place in Hollywood as one of the industry's finest romantic comedy writers. She wrote the iconic "When Harry Met Sally ... " and directed numerous films, including the Tom Hanks and Meg Ryan-starring "Sleepless in Seattle" and "You've Got Mail." Her final film as writer and director was "Julie & Julia."

"I won't say, 'Rest in peace, Nora,' " Smith wrote in her eulogy of Ephron. "I will just ask, 'What the hell will we do without you?' "

Court keeps upcoming health care decision secret

WASHINGTON (AP) ? It's the biggest secret in a city known for not keeping them.

The nine Supreme Court justices and more than three dozen other people have kept quiet for more than two months about how the high court is going to rule on the constitutionality of President Barack Obama's health care overhaul.

This is information that could move markets, turn economies and greatly affect this fall's national elections, including the presidential contest between Obama and Republican challenger Mitt Romney. But unlike the Congress and the executive branch, which seem to leak information willy-nilly, the Supreme Court, from the chief justice down to the lowliest clerk, appears to truly value silence when it comes to upcoming court opinions, big and small.

No one talks, and that's the way they like it.

Contrast this with the rest of the government, which couldn't keep secret President Barack Obama's direct role in supervising an unprecedented U.S. cyberattack on Iran's nuclear facilities or the existence of a double agent inside al-Qaida's Yemen branch who tipped the U.S. to a new design for a bomb to put on a jetliner.

As Republicans air their suspicion that the leaks might be deliberate to enhance the Obama administration's stature, Attorney General Eric Holder has appointed two U.S. attorneys to investigate those two disclosures and probably additional recent national security leaks. Because far more people, of necessity, know about such secret national security operations, those investigators must examine hundreds, even thousands, of federal workers who might have known at least a chunk of the guarded information.

The Supreme Court is expected to rule on the law in the upcoming week or so. Justice Ruth Bader Ginsburg, speaking to a lawyers' convention June 15, noted a steady stream of "rumors and fifth-hand accounts" in the media about what the high court was likely to do.

"My favorite among the press pieces wisely observed: 'At the Supreme Court ... those who know don't talk, and those who talk don't know,'" she said.

The justices, of course, know, having officially voted on the results the same week they heard arguments. But they are not the only ones in the loop: Each of the nine justices has four clerks who know not only how their justice voted but also how the other justices stand because these clerks help research and craft the majority opinions and dissents that are circulated for justices to sign if they agree.

In addition these 45 people surely in the know, there are an assorted number of secretaries, aides, security guards, janitors, support staff and family members keenly attuned to the inner workings of the Supreme Court's upper floors where the justices keep their chambers. At the last moment possible, printers who prepare the paper opinions to be handed out will know.

If any of these people also know anything about how the case is going to come out, they're not talking.

Unlike the president, who needs to be re-elected every four years and needs positive publicity to help, the justices have lifetime appointments and don't need favorable publicity to keep their jobs. Unlike the other constitutional branches, the justices rarely appear on television and don't even allow cameras inside their main workplace, the Supreme Court.

But that silence trickles down even beyond the justices.

Those 36 clerks, who have inside knowledge of the court's deliberations, are just as mum as their bosses despite growing up in the Internet age of bloggers, camera-phones, social media and instantly free-flowing information.

Clerks are warned from day one not to reveal anything about their work, said lawyer Stephen Miller, who clerked for Justice Antonin Scalia.

Miller remembered Chief Justice William Rehnquist warning all of the clerks in his year of the perils of leaking information from the court. "Leaks were unacceptable," Miller remembers the chief justice sternly telling all of them.

In addition to losing their job, one of the most highly sought positions for up-and-coming lawyers in the nation because it usually leads to a six-figure salary upon completion, any clerk caught revealing information would immediately be ostracized in the legal profession, Miller said. No law firm would be willing to take a chance on a lawyer who talks or leaks information to outsiders without permission.

If the leaking clerk isn't caught, the entire class would have that stigma, leading to strong peer pressure to stay silent, he said.

"So what's in it for a clerk to leak?" Miller said.

The court's mystique and reputation for silence means there have been no special warnings from the justices for employees not to spill the beans on the health care decision. It's not that the health care decision isn't important. It's that clerks, secretaries, aides, janitors, and all of the other staff know they are not supposed to talk about anything the court does until the official announcement.

That doesn't mean that the court's always been perfect at withholding information until its formal release. For example, the court inadvertently posted opinions and orders on its website about a half hour too soon in December.

The last apparent leak occurred more than 30 years ago when Tim O'Brien, then a reporter for ABC News, informed viewers that the court planned to issue a particular opinion the following day. Chief Justice Warren Burger accused an employee in the printing shop of tipping O'Brien and had the employee transferred to a different job.

Miller noted that all the lampposts at the entrances and exits of the Supreme Court building are supported by turtle sculptures, which can also be found elsewhere in the building. It's an apt symbol for the court.

"They like information to move slowly and deliberately," Miller said.
